NOTICE OF FORECLOSURE SALE

STATE OF TENNESSEE, JACKSON COUNTY

 

WHEREAS, Roy L. Hudgins and Patricia A. Hudgins executed a Deed of Trust to Mortgage Electronic Registration Systems, Inc. as nominee for Alliance Financial Resources, LLC, Lender and First American Title Insurance Company, Trustee(s), which was dated August 13, 2016 and recorded on August 23, 2016 in Book 82, Page 197, Jackson County, Tennessee Register of Deeds.

WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, 360 Mortgage Group, LLC, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on May 1, 2018, at 12:00PM at the usual and customary location at the Jackson County Courthouse, Gainesboro, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Jackson County, Tennessee, to wit:

Real property in the City of Hilham, County of JACKSON, State of Tennessee, described as follows:

TRACT NO. 1:

This is Tract No. 4 of the Lena Phillips Property.

BEING located in the 6th Civil District, Jackson County, Tennessee, on the east side of New Hope Road, and being a portion of the property of record in Deed Book G-4, Page 372, Register’s Office, Jackson County, Tennessee. See Tax Map 47, Parcel 6.21, Tax Assessor’s Office Jackson County, Tennessee, and more particularly described as follows:

BEGINNING at an iron rod in the east margin of New Hope Road, same being the northwest corner of this tract and the southwest corner of Michael Boles (RB40, PG327, ROJCT); thence leaving road with line of Boles North 80 degrees 17 minutes 40 seconds East 259.09 feet to an iron rod; thence with line of Tract #6 of the Lena Phillips property (2.52 acres as per survey of same date) South 05 degrees 46 minutes 51 seconds East 411.21 feet to an iron rod; thence with line of Tract #5 of the Lena Phillips property (1.07 acres as per survey of same date) South 84 degrees 13 minutes 09 seconds West 222.19 feet to an iron rod in the east margin of New Hope Road; thence with said margin along a curve proceeding counter-clockwise, having a deflection angle of 01 degree 00 minutes 02 seconds, a radius of 4716.20 feet a tangent length of 41.18 feet, and a chord of North 11 degrees 13 minutes 08 seconds West 82.36 feet; thence along said curve an arc length of 82.36 feet; thence North 11 degrees 43 minutes 09 seconds West 191.23 feet to a point, same being point of curvature of a curve proceeding clockwise, having a deflection angle of 03 degrees 39 minutes 52 seconds, a radius of 1901.60 feet a tangent length of 60.83 feet, and a chord of North 09 degrees 53 minutes 13 seconds West 121.60 feet; thence along said curve an arc length of 121.62 feet to the point of beginning containing 2.23 acres more or less by survey by Carroll Carman, Registered Land Surveyor, Tennessee Number 910, address 150 Middle Ford Road, Hartsville, Tennessee, 37074, dated August 17, 2009.

A 25-feet wide public utility easement exists at the road front of the above described tract as it adjoins New Hope Read.

BEING located in the 6th Civil District Jackson County, Tennessee, on the east side of New Hope Road and the north side of Grady Smith Road, and being a portion of the property of record in Deed Book G-4, Page 372, Register’s Office, Jackson County, Tennessee. See Tax Map 47, Parcel 6.21, Tax Assessors Office, Jackson County, Tennessee, and more particularly described as follows:

BEGINNING at an iron rod in the east margin of New Hope Road, same being the northwest corner of this tract and the southwest corner of Tract #4 of the Lena Phillips property (2.23 acres as per survey of same date), also being 395.21 feet south of the southwest corner of Michael Boles (RB40, PG327, ROJCT) as you measure along said margin; twice leaving road with line of said Tract #4 North 84 degrees 13 minutes 09 seconds East 222.19 feet to an iron rod; thence with line of Tract #6 of the Lena Phillips property (2.52 acres as per survey of same date) South 05 degrees 46 minutes 51 seconds East 220.00 feet to an iron rod in the north margin of Grady Smith Road; thence with said margin along a curve proceeding counter-clockwise, having a deflection angle of 12 degrees 30 minutes 52 seconds, a radius of 274.70 feet, a tangent length of 30.12 feet, and a chord of South 88 degrees 20 minutes 18 seconds West 59.88 feet; thence along said curve an arc length of 60.00 feet; thence South 82 degrees 04 minutes 52 seconds West 118.83 feet to a point same being point of curvature of a curve proceeding clockwise, having a deflection angle of 89 degrees 31 minutes 56 seconds, a radius of 30.00 feet, a tangent length of 29.76 feet and a chord of North 53 degrees 09 minutes 10 seconds West 42.25 feet; thence along said curve an arc length of 46.88 feet to a point in the east margin of New Hope Road; thence with said margin along a curve proceeding counter-clockwise, having a deflection angle of 02 degrees 19 minutes 55 seconds, a radius of 4716.20 feet, a tangent length of 95.99 feet, and a chord of North 09 degrees 33 minutes 10 seconds West 191.93 feet; thence along said curve an arc length of 191.95 feet to the point of beginning containing 1.07 acres more or less by survey by Carroll Carman, Registered Land Surveyor, Tennessee Number 910, address 150 Middle Fork Read, Hartsville, Tennessee, 37074, dated August 17, 2009.

BEING A PART OF the same property conveyed to Kevin Combs and wife, Cynthia Combs, by Deed dated October 14, 2009 and recorded October 19, 2009, of record n Book 58, Page 1861, in the Office of the Register of Deeds of Jackson County, Tennessee.

THEREAFTER, BEING A PART OF the same property conveyed to Citizens Bank of Lafayette, by Substitute Trustee’s Deed dated November 20, 2014 and recorded November 20, 2014, of record in Book 76, Page 129, in the office aforesaid.

THEREAFTER, BEING A PART OF the same property conveyed to Roy L. Hudgins and wife, Patricia A. Hudgins, by Deed dated October 30, 2015 and recorded November 3, 2015, of record in Book 79, Page 372, in the office aforesaid.

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and

All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
