WHEREAS, on the 5th day of July, 2007, Mary Sykes, formerly Mary Larsen, executed a Deed of Trust to Fred R. Lawson, Trustee, to secure a promissory note in the amount of $10,000.00 payable to BankEast Bank, Gainesboro, Tennessee, and modified to an amount of $15,500.00 which Note and Deed of Trust have been assigned to Citizens Bank of Lafayette, Tennessee, in Record Book 61, page 1381, in the Register’s Office of Jackson County, Tennessee, as fully set forth in said Deed of Trust which is recorded in Record Book 49, page 1253, and modified in Record Book 51, page 613 all recorded in the Register’s Office of Jackson County, Tennessee, to which reference is hereby made, whose power was conveyed to Joe Carter as Successor Trustee, his substitute or designee, by Appointment recorded in Record Book 88, page 1221, in the Register’s Office of Jackson County, Tennessee, the hereinafter described real estate to secure the payment of a Note set out therein; and

Whereas, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, wherein the holder of said indebtedness has declared the entire amount due and payable as provided in said Deed of Trust, and the Trustee has been directed to foreclose on the Deed of Trust. In accordance with, the undersigned Trustee will sell the hereinafter described real estate at public auction for cash at the East door of the Jackson County Courthouse in Gainesboro, Tennessee, on June 7th, 2018, at 10:00 O’clock A.M. The property is to be sold in bar of the equity of redemption and is subject to the lien of all special assessments, if any, and is subject to prior county and city taxes. Subject to any superior liens or deed of trust. No opinion of title is inferred from this foreclosure.

Lying and being in the First (1st) Civil Districts of Jackson County and further described as follows:

Further conveyed is a portion of Lot No. Thirty-One (31) of the Green Acres Subdivision which is more particularly described as follows:

BEGINNING at the Northeast corner of Lot No. Thirty-Two (32) and the Northwest corner of Lot No. Thirty-One (31) according to the above mentioned plat; thence running South 06° 30’ East 158 feet to a point; thence running South 89° 30’ West 73 feet to a point; thence running North 06° 30’ West 152 feet to a point at the corner of the road, thence running with the road North 89° 30’ West 73 feet to the Point of Beginning, being a portion of Lot No. Thirty-One (31).

Mary Larsen et vir, which interest was acquired by Deed from Cecil Alexander of record in Land Deed Book A-4, page 600 in the Register’s Office of Jackson County, Tennessee.

The sale of the above-described property shall be subject to all matters shown on any recorded plan; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; any matter that an accurate survey of the premises might disclose.


All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Trustee.

The right is reserved to adjourn the day of sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.

If the highest bidder cannot pay the bid within twenty-four (24) hours of the sale, the next highest bidder, will be deemed the successful bidder.

This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. This sale may be rescinded at any time.
