Default having been made in the terms, conditions, and payments provided for in that certain Deed of Trust registered January 4, 2013, of record in Record Book 69, Page 1634, Register’s Office for Jackson County, Tennessee, (hereafter “Deed of Trust”) from or executed by Jerry L. Meadows, Jr. and wife Sarah M. Meadows (”Borrowers”) to James Elder, Trustee, securing the indebtedness therein described, which indebtedness is now due and unpaid, and has been declared in default by Peoples Bank & Trust Company of Pickett County, the lawful owner and holder thereof; and,
Whereas, James Elder, Trustee having been removed and James Reed Brown having been appointed through Substitution of Trustee, recorded in Record Book 77, Page 794, Register’s Office for Jackson County, Tennessee;
The undersigned, William D. Birdwell, Esq., Trustee, having been appointed through Appointment of Successor Trustee, recorded in Record Book 95, Page 754, Register’s Office for Jackson County, Tennessee;
NOW, WHEREFORE, I, William D. Birdwell, Esq., Trustee, pursuant to said Deed of Trust, having been requested by Peoples Bank & Trust Company of Pickett County, the owner and holder of said indebtedness so to do, and by virtue of the authority and power vested in me by said Deed of Trust will, on April 3, 2020 at 12:00 p.m., at the Door of the Jackson County Courthouse, in Gainesboro, County of Jackson, Tennessee, sell at public outcry to the highest bidder for cash, Twenty Percent (20%) shall be paid down at the time of sale, with the remaining balance due on or before April 30, 2020, by Cashier’s Check (or credit upon the indebtedness secured if the lawful owner and holder thereof is the successful purchaser), with the assistance of Amonett’s Eagle Auction and Realty, LLC, as agent pursuant to T.C.A. § 35-5-114(a) to receive bids and conduct the sale on behalf of said Trustee, free from the statutory right of redemption, homestead, curtsey and dower, appraisement, and the marshalling of liens and assets relating to the property, all of which have been expressly waived by Borrowers in said Deed of Trust, the following-described property:
Located in the Eleventh (11th) Civil District of Jackson County, Tennessee, which, pursuant to TCA 35-5-104(2) has a Concise Description as described in the complete legal description of the property contained in Deed of Trust recorded in Record Book 69, Page 1634, Register’s Office Jackson County, Tennessee, which is the previous and last conveyance of the property,
and Common Description of Whites Bend Lane, Gainesboro, TN 38562, and Map 058; Group -; Ctrl Map 058, and Parcel 005.02, as assessed by the Assessor of Property, Jackson County, Tennessee.
Lien or claim of lien by the United States Internal Revenue Service was not registered in the Register’s Office of Clay County, Tennessee more than 30 days prior to the sale date;
Lien or claim of lien by the State of Tennessee, Tax Enforcement Division, was not registered in the Register’s Office of Clay County, Tennessee more than 30 days prior to the sale date;
This sale is being sold subject to any liens, easements, encumbrances, property taxes, rights of redemption of taxing entities and other matters which are prior in right to the lien of the aforesaid Deed of Trust.

Pursuant to the Service Members Civil Relief Act of 2003, confirmation was obtained on January 21, 2020, that there is no information in the Department of Defense data center that indicates Jerry L. Meadows, Jr. and Sarah M. Meadows are currently on active military duty.

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated September 14, 2009, and the Deed of Trust of even date securing the same, recorded September 26, 2009, in Book No. 58, at Page 1269, in Office of the Register of Deeds for Jackson County, Tennessee, executed by Tracy Sandlin and Tom Sandlin, conveying certain property therein described to Kerry Webb as Trustee for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Acopia, LLC, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Wells Fargo Bank, NA.

Notice is hereby given that on the 16th day of March, 2020, Letter of Testamentary, in respect to the estate of Gladys Hunetr, deceased, who died March 14th, 2020 were issued to the undersigned by the Probate Court of Jackson County, Tennessee.
All persons, resident and non-resident, having claims, matured or unmatured, against the estate are required to file same with the Clerk of the above named Court at the Jackson County Court House, P.O. Box 342, Gainesboro, TN 38562 within the earlier of four (4) months from the date of the first publication of this notice, or twelve (12) months from the decedent’s date of death, otherwise their claims will be forever barred.
