NOTICE TO CREDITORS

ESTATE OF: Rita Sloan Jenkins

Notice is hereby given that on the 5th day of November, 2020, Letter of Testamentary, in respect to the estate of Rita Sloan Jenkins, deceased, who died August 28th, 2020 were issued to the undersigned by the Probate Court of Jackson County, Tennessee.

All persons, resident and non-resident, having claims, matured or unmatured, against the estate are required to file same with the Clerk of the above named Court at the Jackson County Court House, P.O. Box 342, Gainesboro, TN 38562 within the earlier of four (4) months from the date of the first publication of this notice, or twelve (12) months from the decedent’s date of death, otherwise their claims will be forever barred.

In this action, it appearing to the satisfaction of the Clerk, from the Plaintiff’s Complaint, which is sworn to and Motion and Order that has been filed in this Court, that the Defendant JEMINI RAY CHRISMAN’s residence is unknown and cannot be ascertained upon diligent inquiry so that the ordinary process of law cannot be personally served upon him. It is, therefore, ordered that publication be made in the Jackson County Sentinel, a newspaper published in the Town of Gainesboro, Tennessee, for four (4) consecutive weeks, commanding said Defendants to serve upon Jacquelyn M. Scott, Plaintiffs’ Attorney, whose address is P.O. Box 283/216 North Main Street, Carthage, Tennessee 37030 a copy of his Answer to the Complaint on or before THIRTY DAYS of the date of the last publication of this notice and also file the original Answer to the Complaint with the Circuit Court Clerk at his office at 101 E. NOTICE OF TRUSTEE’S SALE AT PUBLIC AUCTION

WHEREAS, by Deed of Trust dated the 6th day of August, 2020, Timothy S. Boles and wife, Hannah R. Hall, did convey in Trust to Lee G. Richardson, Trustee, now Steve Daniels, Substitute Trustee by transfer, dated the 29th day of September, 2020 and made of record in book 98, Page(s) 1477-1479 on September 30th, 2020 at 8:06:34 a.m. at Register of Deeds Office, Jackson County, Tennessee, a certain tract of land to secure payment of a debt payable to Georgie Ray Buck and wife, Lisa L. Buck, Recorded in Deed Book 98, Page(s) 141-144, in the Register of Deeds Office, Jackson County, Tennessee, (the “Deed of Trust”) which is incorporated herein by reference;

WHEREAS, Georgie Ray Buck and Lisa L. Buck are the owner(s) and holder(s) of the Note and beneficiaries of the Deed of Trust; and

WHEREAS, Default has been made in the payment of debts and obligations secured by said Deed of Trust and Georgie Ray Buck and Lisa L. Buck have declared the entire balance due and payable and has instructed the undersigned Substitute Trustee to Foreclose on said Deed of Trust in accordance with its terms and provisions;

The previous and last conveyance being a Warranty Deed from Georgie Ray Buck to Timothy S. Boles and wife, Hannah R. Hall, recorded in Record Book 98, Page 138, Register’s Office, Jackson County, Tennessee.

The equity of redemption, the statutory right of redemption, homestead, and all other exemptions of every kind are waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only such titles as he may convey as Substitute Trustee, there being no representations or covenants of warranty of title made hereby.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements or set back lines that may be applicable; any statutory rights of redemption or any governmental agency, State or Federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.

In addition, there are no known, Individually, Corporations, Limited Liability Companies, U.S. or State or Businesses that have a government interest, or prior right to the lien/Deed of Trust as aforementioned recorded in the Register’s Office, Jackson County, Tennessee.

All interested parties who are interested in purchasing should have a title opinion completed if said purchasers so desire.

However, if there are same on record, said Real Property is being sold subject thereto.

Pursuant to TCA 35-5-101(e), a copy of the above Notice, as required in TCA 35-5-104, was served upon the above referenced debtor and Interested Parties, by lodging same with the U.S. Mail, Certified Mail, Return Receipt Requested, postage prepaid, for delivery to the addresses indicated on or before September 14th, 2020 more than thirty (30) days prior to the first publication date pursuant to the statutory requirements.

Dates of Publication, TCA 35-5-101(a)(b); the Jackson County Sentinel, a newspaper published in Jackson County, Tennessee, the county where the land is located and the sale is to be made, which shall be published in the newspaper n the following dated: November 10, 2020, November 17, 2020 and November 24, 2020.

Said sale shall be made for cash in bar of all right and equity of redemption, homestead, dower and all other rights of exemptions of every kind, all of which are expressly waived in said Deed of Trust.

Trustee is not aware of any lien claimed by the United States with respect to which the provisions of U.S.C. § 7425(b) require notice to be given to the United States. Substitute Trustee is not aware of any lien or claim of lien by the State of Tennessee with respect to which the provisions of §67-1-1433(b) of the Tennessee Code Annotated require notice to be given to the State of Tennessee.

This sale shall further be subject to any announcements made at the time of the sale.

The Substitute Trustee reserves the right to postpone or set over the date of sale in the event the Substitute Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, with such notice of postponement as deemed reasonable by Substitute Trustee. In the event the highest bidder at such sale fails to complete his purchase of the subject Real Property within the applicable time allowed, the undersigned Substitute Trustee reserves the right to complete the sale of the subject real property, without further notice of advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Substitute Trustee. The proceeds derived from the sale of the property will be applied as provided for in said Deed of Trust and are made a part hereof as if set forth verbatim herein.

At the conclusion of the sale, I, Steve Daniels, Substitute Trustee, will make, execute, and deliver a Trustee’s Deed to the purchaser at the sale of the herein described land, as Substitute Trustee, in as full and ample manner as the Substitute Trustee can convey the same.
