WHEREAS, Mike J. Delape executed a Deed of Trust to Conseco Finance Corp – Alabama, Lender and William C. Ford, Trustee(s), which was dated March 20, 2002, and recorded on March 27, 2002, in Book 15, at Page 605, subsequently re-recorded April 27, 2002 in Book 16, Page 630 in Jackson County, Tennessee Register of Deeds.

WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, U.S. Bank National Association, as Trustee, for Manufactured Housing Contract Senior/Subordinate Pass-Through Certificate Trust 2002-2, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

Wiggins, R.L.S. #70, Box 191, Gainesboro, Tennessee, dated November 8, 1993.
The following restrictions shall apply to the above described property:
1. This property shall be sued only for residential purposes. No commercial or industrial uses are permitted.
2. The exterior of this house/residence erected on this lot shall not remain unfinished for a period longer than twelve (12) months from the date construction began.
3. A double wide or modular home shall be permitted on this tract, No single wide house trailers shall be permitted on this tract, or on any lot or tract fronting on Grady Pigg Lane.
4. No swine, goats or poultry shall be kept on this property and no activity of any sort that would constitute a nuisance to the adjoining property owners shall be conducted on the property.
5. No junkyards shall be operated or maintained on this property.
6. No refuse pile, junked cars or other unsightly objects shall be allowed to be placed or suffer to remain anywhere thereon.
7. No establishment for the sale of alcoholic beverages shall be maintained upon the property.

WHEREAS, on the 4th day of September, 2020, Deed of Trust of record in the Register’s Office of Jackson County, Tennessee in Record Book 98, Page 1028, BARRY FORD conveyed to JACKY O.
